FTC Announces Impersonation Rule

The Federal Trade Commission (FTC) implemented a new rule on April 1, 2024, specifically aimed at impersonation of businesses and government agencies [FTC impersonation rule]. This rule strengthens the FTC’s ability to fight impersonation scams by allowing them to seek financial compensation for consumers and impose civil penalties on those who violate the rule.

The FTC took its first action under this new rule in July 2024 against a student loan debt relief organization that allegedly impersonated the Department of Education to swindle over $20 million from consumers [First FTC Impersonation Rule case]. This case highlights the FTC’s commitment to using this new rule to protect consumers from deceptive practices.

The FTC is also considering further measures to expand the rule’s scope. They are accepting public comments on a proposal to outlaw impersonation of individuals and to take action against those who assist scammers with impersonation techniques.

Given the shortcomings of existing tools in the fight against impersonation, two key areas of focus that the FTC is recommended to consider involve next generation digital identity: (1) Organizational Identity (what business, government, or NGO is taking responsibility for a consumer contact attempt) and (2) Bot vs. Human, the ability to identify where a communications attempt is from a human being or synthesize voice and/or conversational AI.“… [see more]
